You must create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. We reserve the right to terminate accounts that violate these Terms.
You agree not to: (a) use the Service for any unlawful purpose; (b) transmit harmful, offensive, or infringing content; (c) attempt to gain unauthorised access to any part of the Service; (d) use automated tools to scrape or abuse the Service; (e) reverse-engineer or decompile any part of the Service; (f) use the Service to harm minors or engage in harassment.
The Service and its original content, features, and functionality are and will remain the exclusive property of Placeaware and its licensors. Our trade marks and trade dress may not be used in connection with any product or service without prior written consent.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of data you submit to the Service. By using the Service, you grant us a limited licence to process your data solely to provide and improve the Service.
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
To the maximum extent permitted by law, Placeaware shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We reserve the right to modify these Terms at any time. We will notify users of material changes by email or by posting a notice on our website. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.
